In certain countries, the role of a property agent is unregulated, allowing anyone to identify as a broker and engage in mediation. However, in Italy, this profession is legally protected (agente di affari in mediazione, art. 1754 Codice Civile). A broker acts as an independent entity, duty-bound to represent both the buyer's and seller's interests. Under Italian law, a mediator is defined as 'the individual who facilitates the meeting of two or more parties to form a contract, without being bound to any by cooperative, dependent, or representative ties'. This stipulates that the property agent must remain neutral and advocate for both sides equally. Only those who are fully licensed as real estate agents are permitted to mediate in property transactions. Such agents have not only completed professional training through the Chamber of Commerce but also earned their license by passing a qualifying examination. They must also secure professional liability insurance and be registered in the Real Estate Agents Register (REA) at the local chamber of commerce.
